Terms of Service

Effective Date: April 10, 2026

These Terms of Service ("Terms") govern your use of the Boursati (بورصتي) mobile application ("the App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By creating an account or using the App in any way, the user acknowledges that they have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any applicable laws and regulations of the State of Kuwait. These Terms constitute a legally binding agreement between the user and the developer of Boursati.

2. Service Description

Boursati is a mobile investment tracking application designed for the Kuwait Stock Exchange (Boursa Kuwait). The App provides the following functionality:

• Display of stock prices, fundamentals, and corporate disclosures sourced from publicly available data
• Portfolio tracking tools for users to manually record their stock holdings
• Watchlist and price alert features
• AI-generated Arabic-language market summaries
• Dividend tracking and calculations
• Transaction history recording

The App is an informational tool only. It is not a trading platform, brokerage service, or financial advisory service. The App does not execute trades, manage investments, or connect to any brokerage or bank accounts.

3. Account Registration

To use certain features of the App, the user must create an account through our authentication provider, Clerk. When registering, the user agrees to:

• Provide accurate, current, and complete information
• Maintain and update their information to keep it accurate and current
• Maintain the security and confidentiality of their login credentials
• Accept responsibility for all activities that occur under their account
• Notify us immediately of any unauthorized use of their account

Each individual may maintain only one account. The user must be at least 13 years of age to create an account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Free Access

The current version of the App is free to use. The App does not sell paid digital content, paid subscriptions, or paid feature unlocks. There is no external payment flow, website checkout, license key, or other purchase mechanism for unlocking App functionality.

If paid digital features are introduced in a future version, those features will be submitted in a future App Store build and made available using Apple In-App Purchase where required by App Store rules.

5. Feature Availability

The following features are currently available without payment:

• Stock list, company pages, current prices, and charts
• Portfolio management, transaction history, watchlist, and price alerts
• AI-generated market summaries, dividend tracking, disclosures, and financial information

We reserve the right to modify App features in future versions.

6. Data Accuracy Disclaimer

Market data displayed in the App is sourced from Boursa Kuwait (public API) and Yahoo Finance (public API). The user acknowledges and agrees that:

• Market data may be delayed and does not represent real-time prices
• Data may contain inaccuracies, errors, or omissions
• The App is not a source of real-time trading data and must not be relied upon for time-sensitive trading decisions
• Fundamental data, financial ratios, and corporate disclosures may be incomplete or outdated
• AI-generated market summaries are automated and may contain errors or misinterpretations
• Portfolio calculations (profit/loss, dividends, performance) are based on user-entered data and may not reflect actual brokerage account balances
• The developer makes no warranty regarding the accuracy, completeness, timeliness, or reliability of any data displayed in the App

The user should not make financial decisions based solely on data provided by this App. The user is strongly encouraged to verify all information with their licensed broker or official exchange sources before making any investment decision.

7. User Conduct

When using the App, the user agrees not to:

• Use the App for any unlawful purpose or in violation of any applicable Kuwaiti laws or regulations
• Attempt to access, tamper with, or use non-public areas of the App, our servers, or our service providers' systems
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App
• Scrape, crawl, or use automated means to extract data from the App or its APIs
• Abuse, overload, or interfere with the App's servers or infrastructure
• Attempt to access, interfere with, or disrupt non-public areas of the App, our servers, or our service providers' systems
• Share, transfer, or sell their account credentials to any other person
• Use the App to disseminate false or misleading financial information
• Impersonate any person or entity or misrepresent their affiliation with any person or entity

Violation of these conduct rules may result in immediate termination of the user's account without notice or refund.

8. Intellectual Property

The App, including its design, code, features, graphics, user interface, and all related intellectual property, is owned by the developer and is protected under applicable copyright, trademark, and intellectual property laws of the State of Kuwait and international treaties.

Market data displayed in the App is sourced from and owned by their respective providers (Boursa Kuwait, Yahoo Finance). The user acknowledges that such data is subject to the terms and conditions of the original data providers.

The user may not copy, modify, distribute, sell, lease, or create derivative works based on the App or its content without the prior written consent of the developer.

9. Limitation of Liability

To the maximum extent permitted by applicable law, including the Kuwait Civil Code (القانون المدني الكويتي):

• The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
• The developer shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to the use of the App, including but not limited to:
  • Financial losses resulting from investment decisions made using or influenced by the App
  • Losses due to inaccurate, delayed, or incomplete market data
  • Losses due to service interruptions, downtime, or technical failures
  • Losses due to unauthorized access to the user's account
  • Any damages arising from reliance on AI-generated content
• In no event shall the developer's total aggregate liability exceed the greater of the amount paid by the user for the App in the twelve (12) months preceding the claim or 10 KWD.

10. Indemnification

The user agrees to indemnify, defend, and hold harmless the developer from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to:

• The user's use of the App
• The user's violation of these Terms
• The user's violation of any rights of a third party
• Any investment decisions made by the user based on information provided by the App

11. Termination

We may suspend or terminate the user's access to the App at any time, with or without cause, and with or without notice, if we reasonably believe that the user has violated these Terms. Upon termination:

• The user's right to use the App ceases immediately
• We may delete the user's account and all associated data

The user may delete their account at any time through the App or by contacting support@boursati.app.

12. Apple App Store Terms

The user acknowledges and agrees that:

• These Terms are between the user and the developer only, and not with Apple Inc. ("Apple")
• Apple has no obligation to furnish any maintenance or support services with respect to the App
• Apple is not responsible for any product warranties, whether express or implied by law. In the event of any failure of the App to conform to any applicable warranty, the user may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to the App
• Apple is not responsible for addressing any claims by the user or any third party relating to the App or the user's possession and/or use of the App
• In the event of any third-party claim that the App or the user's possession and use of the App infringes that third party's intellectual property rights, Apple will not be responsible for the investigation, defense, settlement, or discharge of any such intellectual property infringement claim
• Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon the user's acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against the user as a third-party beneficiary

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Kuwait, including but not limited to the Kuwait Civil Code (القانون المدني الكويتي — Law No. 67 of 1980) and the Kuwait Commercial Code (قانون التجارة الكويتي — Law No. 68 of 1980), without regard to conflict of law principles.

Any dispute, controversy, or claim arising out of or relating to these Terms or the use of the App shall be subject to the exclusive jurisdiction of the competent courts of the State of Kuwait, located in Kuwait City.

The user irrevocably submits to the jurisdiction of the courts of Kuwait for the resolution of any such dispute.

14. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent of the parties.

15. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between the user and the developer regarding the use of the App, and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written.

16. Waiver

The failure of the developer to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. A waiver of any default shall not constitute a waiver of any subsequent default.

17. Changes to These Terms

We reserve the right to modify these Terms at any time. When we do, we will revise the "Effective Date" at the top of this page. The user's continued use of the App after any changes constitutes acceptance of the modified Terms. For material changes, we will make reasonable efforts to notify the user through the App or via email.
